Terms of Service for the website sportspickz.com, our Telegram bot and our pick emails.

1.Definitions

  1. Service — the website sportspickz.com, our Telegram bot and our pick emails.
  2. Operator ("we", "us") — SportsPickz, Radom, Poland, the operator of the Service. Contact details are on the Contact page.
  3. User ("you") — a person 21 or older who uses the Service.
  4. Pick — our own statistical sports analysis or opinion about a sporting event (NFL, NBA, NHL, MLB, MLS, NCAA and other leagues), delivered as digital content.
  5. Subscription — an agreement for the delivery of Picks for an indefinite period, renewing automatically every month.
  6. Trial — the first 3 days of the Subscription, free of charge.
  7. Channel — our Telegram bot or our daily email, whichever you choose, through which Picks are delivered.
  8. Whop — Whop, Inc., the payment provider that processes payments and lets you manage your Subscription.

2.Operator and contact

  2. Contact, complaints and cancellations: support@sportspickz.com. We communicate in English.

3.The service

  1. Under the Subscription, we deliver through the Channel at least 30 Picks in each monthly billing period, and at least 3 Picks during the Trial.
  2. Each Pick names the event (league, teams, date and time), the bet, the American odds at the time we send it, a suggested stake in units and the author's opinion. Picks are delivered before the event starts, usually by 11 AM ET.
  3. What we provide is the delivery of Picks as described in points 1–2 of this section. It does not include the outcome of any event, the accuracy of any Pick, any profit for you, or placing or settling any bet with anyone. A losing Pick is not a defect in the service.
  4. Picks are for entertainment and informational purposes only. They are not financial or investment advice, not a recommendation to place any bet, and do not guarantee any winnings. Past results do not predict future results.
  5. Any decision to use a Pick is yours alone, made at your own risk.

4.No gambling activity

  1. We are not a sportsbook or gambling operator. We do not accept bets, act as an intermediary for bets, take stakes or pay out winnings.
  2. Subscription fees pay only for digital content and do not give you a right to any winnings.
  3. We do not receive payments from sportsbooks for your bets. If you bet, do it only with a sportsbook licensed in your state, and only where sports betting is legal. You are responsible for knowing the laws where you live. The Service is void where prohibited.

5.Signing up and payments

  1. To use the Service you need a device with internet access, a Telegram account or an email address, and a payment card or another method accepted by Whop.
  2. Prices (in US dollars):
    • Trial — 3 days, $0;
    • $29 per month — charged automatically by Whop to your payment method, for the first time on the day the Trial ends, and every month after that, until you cancel. Sales tax may apply.
  3. At checkout you:
    • confirm that you are 21 or older and accept these Terms and the Privacy Policy;
    • check a required, unchecked box agreeing that the Trial converts to a paid Subscription that renews automatically at $29/month until you cancel;
    • see next to the payment button all amounts from point 2 of this section and the date of your first $29 charge.
  4. The agreement is made when your Trial starts. Right after that, we email you a confirmation with the amounts, the date of your first charge, how to cancel online and a link to these Terms. You get access to the Channel right away. One Trial per person.
  5. Before the Trial ends, we email you a reminder of your first $29 charge. While your Subscription is active, we also send a yearly reminder of its terms.
  6. If a payment fails, Whop may retry it. If the payment cannot be collected, the Subscription ends and access stops.
  7. A price change requires at least 30 days' notice by email. If you do not agree, you can cancel before the new price applies.

6.Digital content and refunds

  1. The Subscription and every other paid product in the Service are digital content delivered right after you sign up.
  2. By starting the Trial you ask us to start delivering Picks immediately. Because Picks cannot be returned once delivered, fees are non-refundable and we do not give refunds or credits for partial periods, at signup or at renewal, except as stated in section 7 or where the law requires it.
  3. This does not limit your right to cancel (section 8) or to file a complaint (section 7).

7.Complaints

  1. We are responsible for delivering Picks as described in these Terms for as long as your Subscription lasts.
  2. A defect means, in particular: fewer than 30 Picks in a monthly billing period, a Pick delivered after the event started, or no access to the Channel for reasons on our side. A losing Pick is not a defect (section 3.3).
  3. Send complaints to support@sportspickz.com, describing the problem. We reply within 14 days.
  4. You can ask us to fix the problem (for example, deliver the missing Picks or restore access). If that is not possible or does not work, we lower the price or refund the affected period within 14 days.

8.Cancellation

  1. You can cancel anytime, without giving a reason and at no cost:
    • by email to support@sportspickz.com or by replying to any of our emails. We cancel as soon as we receive your message;
    • online, in your Whop account at whop.com (Orders → SportsPickz → Cancel).
  2. After you cancel, no further charges are made. Access continues until the end of the period you paid for. If you cancel during the Trial, the $29 charge is not made.
  3. We confirm every cancellation by email.
  4. We may end the agreement immediately, without a refund, if you share Picks or access to the Channel with others, misuse the Service, or gave a false statement about your age.

9.Liability and copyright

  1. The Service and the Picks are provided "as is" and "as available". To the fullest extent the law allows, we give no warranty about the accuracy, timing or results of Picks.
  2. Because what we provide is the delivery of Picks (section 3), we are not liable for betting losses or any other financial decisions you make, for the actions of sportsbooks, or for how sporting events turn out.
  3. We are not liable for interruptions caused only by outages at Telegram, email providers, the internet or your device. This does not limit your rights under section 7 for Picks we did not deliver.
  4. To the fullest extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 3 months before the claim, and we are not liable for indirect or consequential damages.
  5. Picks are protected by copyright. You may use them only for your own personal use. Copying, publishing, reselling Picks or sharing access to the Channel is prohibited.
  6. League and team names and logos belong to their owners and are used only to identify events. We are not affiliated with or endorsed by any league, team or sportsbook.

10.Personal data

How we handle personal data, including sharing it with Whop, is described in our Privacy Policy.

11.21+ only. Bet responsibly

  1. The Service is only for people 21 and older.
  2. Betting comes with the risk of losing money and can be addictive. Only bet amounts you can afford to lose, and do not treat betting as a source of income.

12.Changes and final provisions

  1. We may change these Terms for important reasons: changes in the law, a decision of an authority or court, a change in the scope of the Service, or to prevent abuse.
  2. Users with an active Subscription are told about changes by email at least 30 days before they take effect. If you do not agree, you can cancel before that date (section 8); until the end of your paid period the previous Terms apply. A price change follows section 5.7.
  3. Before any formal dispute, please contact us at support@sportspickz.com. Most issues are solved quickly that way.
  4. Any dispute we cannot resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held online or by phone, except that either side may bring an individual claim in small-claims court. You and we waive the right to a jury trial and to take part in any class or representative action. You can opt out of arbitration by emailing support@sportspickz.com within 30 days of first accepting these Terms, with the subject "Arbitration opt-out".
  5. These Terms are governed by the laws of Poland, without affecting any mandatory consumer protection laws of the state where you live.
  6. If any part of these Terms is found unenforceable, the rest remains in effect.
  7. These Terms are available free of charge on the Service and can be saved or printed.
